Cricket Update: Shikhar Dhawan, the veteran Indian opener, will soon be reunited with his nine-year-old son Zoravar after a Delhi family court ordered the estranged Dhawan’s wife, Ayesha Mukherjee, to go to India for a family reunion. Aesha must attend the family gathering next month, according to the court, because “a mother alone does not possess exclusive rights over a child.”
Since August 2020, Shikhar Dhawan’s family has not been able to visit his son, who lives with his mother in Australia. The judge rejected Dhawan’s first request because his kid had missed crucial school assignments. Dhawan’s wife similarly turned down their invitation, saying that the family gathering wouldn’t draw many guests and that the mother-son team didn’t need to go.
However, after Dhawan’s family rescheduled the celebration to coincide with the child’s school vacations, a family court in Delhi interfered in the situation and ordered Dhawan’s wife to attend the gathering. The court determined that a father had the right to meet his son as well, particularly after such a protracted absence.
“Why, therefore, would she object to the petitioner meeting his own kid since he is not a terrible father, given that the mother alone does not have parental rights over the child? Both parties must share responsibility for the family’s environmental pollution. When one person expresses worries and the other person does not acknowledge them or pay attention, a disagreement results,” according to Judge Harish Kumar of the family court at Delhi’s Patiala House Courts.
As soon as Aesha questioned their jurisdiction, the Delhi court admonished her.
The Indian cricketer’s wife’s misconduct in urging an Australian court to place him on a watch list was also brought up by the court. Notably, Aesha was also reprimanded last month for doubting the Indian court’s authority in the case involving the kid.
“Her objection to the cost may be legitimate, and her subsequent protest may be acceptable, but her unwillingness may not be legitimate. She has not been able to explain why she asked the Australian court to place the petitioner on the watch list or what concern she has regarding the petitioner with regard to the kid. If the petitioner had meant to use force to get custody of the kid, he would not have gone to an Indian court,” it was said.
